Modi surname case: Jharkhand HC says no coercive action against Rahul Gandhi till July 15

The Jharkhand High Court has stayed the proceedings of a lower court against Rahul Gandhi over alleged defamatory remarks against ‘people with Modi surname’.

The Jharkhand High Court on Monday granted relief to Rahul Gandhi against the warrant issued by the lower court over the Congress leader’s alleged derogatory remark on ‘Modi surname’

Congress leader Rahul Gandhi had sought time from Jharkhand High Court to file a reply in the case that was lodged against him for using derogatory remarks against Modi surname. While campaigning for 2019 Lok Sabha elections, Rahul Gandhi had reportedly said, “Nirav Modi, Lalit Modi, Narendra Modi… how come they all have Modi as the common surname. How come all the thieves have Modi as the common surname?”

A PIL was filed against Rahul Gandhi for allegedly using derogatory words against all Modis. Pradip Modi, the complainant, had alleged that Rahul Gandhi’s remark over Modi surname was condemnable. The petitioner had also filed a defamation suit against the Congress leader.

On Monday, a bench of Justice Sanjay Dwivedi accepted Rahul Gandhi’s plea and granted him time till July 15. The High Court had said that no coercive action can be taken against Rahul Gandhi till July 15.

Along with this, the court also stayed the proceedings of the lower court in the matter and issued notice to the petitioner
